Q |​ What is a nondiscrimination statement? How do I find out if my healthcare provider has one?

A patient nondiscrimination statement is a formal declaration by a healthcare organization stating that they will not discriminate against any patient based on certain protected characteristics. The statement ensures that all patients receive equitable and respectful treatment, regardless of individual characteristics. Some healthcare organizations include protections for “sexual orientation” and “gender identity.”
Look for the nondiscrimination statement for the healthcare organization or health system where you get care. It should be posted on the organization’s website, in printed patient materials like brochures, and/or on posters in patient waiting areas.

Q |​ What rights do I have as a patient? What should I do if my rights are violated?

As a patient, your rights include but are not limited to:

The right to nondiscrimination by race, color, national origin, sex, age, or disability under the Affordable Care Act
-
The right to privacy of your health information under the Health Insurance Portability and Accountability Act (HIPAA)
-
The right to self-determination under the Patient Self-Determination Act
-
The right to be free from abuse, mistreatment, and neglect in long-term care under the Nursing Home Reform Act
These are just some of your rights. You should be able to access a state- and institution-specific patient bill of rights through the health system or organization where you receive care. Look for specific protections for gender, gender identity, and sexual orientation.
If you believe your rights have been violated, you can:

Bring a complaint to your healthcare provider or to the health system where you receive care.

File an appeal, if your complaint relates to denial of insurance coverage.

Seek legal counsel.

File a discrimination complaint with state or federal agencies.

Q |​ How can housing access and housing policy affect healthcare for trans people?
​
Currently, over half of US states do not prohibit housing discrimination based on sexual orientation and gender identity. Trans people are at higher risk for housing insecurity or being without stable or safe living arrangements.
Housing insecurity can have a negative impact on healthcare for trans people. For example, trans adults who are unhoused may have a hard time securing stable housing for their recovery after surgery.
At the same time, some housing communities are welcoming to trans adults. For example, trans older adults may have access to LGBTQIA-inclusive senior housing in some areas, which can support their health and wellbeing.
